Introduction

Digital Leisure Holdings Pty Ltd (ACN 661 695 389, ABN 97 661 695 389) (hereinafter referred to as ‘Chrono Culture’ or We’ or ‘Us’ or ‘Our’) is conducting a lucky draw (hereinafter referred to as the ‘Contest’) for Individuals (hereinafter referred to as ‘Participants’ or ‘You’ or ‘Your’). The Contest will commence on the 16th of August 2023 at 12:01am and will conclude on the 16th of November 2023 11:59pm (‘Contest Period’). The draw will be held 48 hours after the Contest Period is completed. This contest has a maximum limit of 500 entries (purchased from a digital art poster package). If the maximum number of entries is achieved earlier, the contest and draw date will be rescheduled to an earlier date. There will be a maximum number of 1 winner.

 

Prizes

Our total prize pool is valued at $15,000 which is made up of and will be drawn in the following order;

- 1st Prize – 2022 Rolex Datejust reference 126300-0017, Valued at $15,000

 

Eligibility

To be eligible to enter the contest you must purchase one of our official digital art poster packages during the Contest Period. This will automatically enter you into the contest at no additional fee. Each Package comes with a unique license key permitting a single download. The Packages and their content are for the exclusive use of the purchaser and may not be shared, redistributed, or used in any manner inconsistent with this agreement. The Packages are available for purchase exclusively through our official website at https://www.chronoculture.com.au

 

By purchasing a package, you agree that you have read these Terms & Conditions and agree to be bound by them. All purchases of Official Digital Poster Art Packages are final and refunds due to a change of mind or at the conclusion of the promotion are not accepted unless otherwise defined by the Chrono Culture refund policy.

The draw is open to all Australian residents (excluding South Australian residents) over the age of 18 who enter in accordance with these terms and conditions of entry, except for employees of Chrono Culture, their immediate family members (parents, spouses, domestic partners, siblings and children) or any other person residing in their household.

 

In addition, the first 500 digital art poster packages sold during the Contest Period will be entered into the Contest. Once 500 digital art poster packages are sold, this part of the draw will be automatically closed. We will announce on our social media platforms if we reach the limit. Please note that each Participant may gain more than one entry in the competition by purchasing multiple digital art poster packages.

 

Watch Prize

The first prize winner may choose to take a cash prize of $10,000 instead of the watch. The Winner will have 24 hours to decide between the cash or the watch. Chrono Culture cannot provide the Winner with any financial or other advice as to which option they should choose.

In the event that the winner takes the watch we will not cover the costs of servicing the watch. The winner is solely responsible for paying any parts, servicing and operating costs associated with the watch. Where a watch includes custom modifications, the winner acknowledges that replacement parts may not be available in the future. The winner acknowledges that Chrono Culture will not be responsible for any costs associated with any costs of maintenance, operation or any other costs that are not stated in these terms. Chrono Culture is not liable for any damages incurred to any prizes after delivery. Winners will have 24 hours to bring any issues or imperfections forward to Chrono Culture for review regarding prizes before they are deemed to have been accepted in the condition it arrived. Once this time period has passed, any issues relating to the watch will no longer be the responsibility of Chrono Culture. We will hand over the prize to the winner Australia-wide, within 28 business days of announcing the winner subject to the prize winner being within a reasonable distance from a metropolitan area and subject to logistics and transportation availability. If the winner resides in Perth Western Australia, the winner has a choice to receive the prize in person or have it delivered via secure shipping.

In the event that the winner chooses the $10,000 cash prize option, the watch will remain as a property of Chrono Culture and it will be held under our possession. The watch will not be redrawn if the winner chooses the cash prize option.

 

The Draw

The draw will take place at 3:00pm AWST on the 18th of November 2023 and will be held at Level 1, 355 Scarborough Beach Rd, Osborne Park 6017. The contest will be scrutinized by an independent third-party. The winner will be determined by using an electronic drawing system hosted on randomdraws.com.au.This random draw system is a secure infrastructure and is government certified and compliant for all Australian states. A certificate of compliance will also be shown to the public. This process will also be live streamed via our Facebook and Instagram page. The winner will be drawn and contacted immediately via phone and email. We will publish the names of winners on our Facebook, Instagram and website on the 18th Of November 2023. Participants agree that if they win, they will participate in a prize acceptance handover video or photograph for publication on our website.

 

If the prize is unclaimed for longer than 90 days from the initial draw, we will make an announcement on the 19th of February 2024 and then conduct a redraw on the 21st of March 2023 at 3 pm. The winner of the redraw will be published to our Facebook, Instagram and website on the 21st November 2024.

 

Every Participant has a random, fair and equal chance of winning. Accordingly, one Participant can win multiple prizes in the competition.Each winner must sign a Prize Acceptance Form as reasonably required by Chrono Culture before receiving their prize.

 

Representations and Warranties

Chrono Culture Australia warrants the following;

  1. The watches involved in the contest are owned by Chrono Culture;
  2. The purpose of this draw is to promote and develop the Chrono Culture brand and bring recognition to the Chrono Culture brand;
  3. We will not sell raffle tickets, or any other form of ticket to enter this contest. Entry to the contest is strictly provided as a promotion when purchasing a digital art poster package with us, and cannot be purchased separately; and
  4. The contest is wholly funded and solely promoted by Chrono Culture, ABN 97661695389
  5. The Participant represents and warrants that it shall not contact any affiliate, employee, sponsor, or partner of Chrono Culture in order to manipulate the Contest results.

 

Disclaimers

  1. Participants hereby waive all rights to claim punitive, incidental, or consequential damage and any rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out of pocket expenses incurred in entering the contest.
  2. In no event will Chrono Culture, our licensees, parents, affiliates, subsidiaries and related companies, our advertising or promotional agencies or respective officers, directors, employees, representatives and agents, be responsible or liable for any damages or losses of any kind, including direct, indirect, incidental, consequential or punitive damages arising from participation in this contest.
  3. Chrono Culture reserves the right to disqualify any Participant found to be tampering with or otherwise abusing any aspect of this Contest as solely determined by Chrono Culture.
  4. In the event the Contest is compromised by non-authorised human intervention, tampering or other causes beyond the reasonable control of Chrono Culture, that corrupt or impair the administration, security, fairness or proper operation of the Contest, Chrono Culture reserves the right to suspend, modify or terminate the Contest.
  5. Any attempt by a Participant to deliberately damage the website or undermine the legitimate operation of this contest is a violation of criminal and civil laws, and should
  6. such an attempt be made, Chrono Culture reserves the right to seek damages from any such Participant to the fullest extent permitted by law.
  7. Chrono Culture assumes no responsibility for any problems or technical malfunction of computer systems, servers, software, internet service provider, or e-mail systems, failure of any entry to be received on account of technical problems or incomplete, late, lost, damaged, illegible or misdirected electronic communications, or any combination thereof.
  8. The Contest is void where prohibited or restricted by law.
